TERMS AND CONDITIONS This Web site is operated by Fireplacemall.co.uk and and you are registering on fireplace mall to purchase goods from main mall or from any other shop created by any other retailer to sell goods on fireplace mall and these terms and conditions apply as general but when you purchase from mini store then their terms and conditions may differ so you may have to agree again before you purchase from any other shop. These terms will apply to all your purchases from our mini store, whether you are ordering on line or by telephone. Please read this document carefully and print it off or download it before placing your order. We may change these terms from time to time. Please check them before you make a new purchase. For any problem or after sale you must note contact details of store you purchased from and should directly communicate with them and not with fireplace Mall who only manage website ,mini stores or retailers like us. To use this website you must be over 18 years or above. 1-PAYMENT OPTIONS You will pay for your order by Visa, MasterCard, Delta/Connect, Switch or Amex if paying by card or as options may be in our checkout process. We will take all reasonable care to keep your order details and payment secure and this website uses highest standards of securing website to avoid any penetration of hackers or unauthorised persons who could gain access to your account so please keep your log in details secure otherwise we will not be liable for any losses if an unauthorised third party obtains access to your information. 2-ADDRESS REQUIREMENTS If billing and delivery addresses are not the same, we may ask for more details and hold your order. Always insert correct billing address as system checks your street address and postcode to authorise payment. 3-VAT INFORMATION All prices quoted on our Web Site include UK VAT and delivery charges unless specified by us. 4-YOUR AGREEMENT WITH US We will confirm acceptance (or otherwise) of your order as soon as possible, either by email (if your order is placed on-line) or by telephone (if your order is placed over the telephone). A binding agreement arises once we accept your order and we will then charge your credit/debit card on acceptance of your order. 5-DELIVERY RADIUS Delivery is to mainland UK only. Unfortunately we do not make overseas deliveries as standard deliveries (please ask). However, there are certain areas where we are able to ship for an additional delivery charge. Please contact us before ordering any goods, should you live in any of the areas listed below, as additional shipping charges will apply. Your order remains on hold if you place order from areas given below without prior arrangements or charges agree with us. 6-ADDITIONAL DELIVERY CHARGES Ireland Isle of Man Isle of Wight Jersey Guernsey Scottish Isles Scottish Highlands (North of Glasgow & Edinburgh) There are no delivery charges for UK main lands and it is free so prices you see are prices you pay. We pride ourselves on our rapid service. We aim to dispatch all orders as soon as possible and will contact you to arrange delivery. As we carry our most popular products in stock, we are able to offer fast delivery times. We usually quote 7 to 10 working days** although some deliveries can be carried out much quicker than this. Some items may be out of stock. If this is the case, these deliveries may take up to another 7 working days on top of our delivery time. This is subject to availability of stocks from manufacturer. ** Working days does not include Saturdays, Sundays or public holidays. if you are in great hurry and product is in stock then we can arrange it quickly like next day without charging you or you can upgrade it to premium service(please call and discuss) which will be charged extra Delivery contract covers:- The delivery charges stated cover ground floor only with a one man delivery, if you have any special requests for delivery (for example you live in a flat) please make us aware of this at time of purchase and we shall endeavour to arrange special delivery for you, this may come with an additional charge, please contact us for further information. We strongly recommend that you do not book fitters for your appliances until you have received and inspected your goods. 7-AVAILABILITY OF PRODUCT All items are subject to availability. We can only guarantee availability of item if you call us and we confirm "it is in stock". If the goods you ordered are unavailable, we will order it from manufacturer and supply when delivered to us. It may take seven to ten days please. Delay in delivery of goods is sometimes is beyond control. Any dates we specify for the delivery of goods are tentative and we shall not be liable for any losses, costs, damages, charges or expenses caused for any delay caused in delivery of the goods. Rest assured we do not hold items unnecessarily and dispatch the day they arrive. 8-DELIVERY PRECAUTIONS Any transit damage, shortages or incorrect goods supplied must be notified on the delivery note at the time of delivery. Please make sure that you thoroughly inspect your goods for any Cosmetic damage, incorrect goods, missing parts or any other problems as soon as you receive you goods, if this is not done after delivery has been made then you are required to contact us within 7 working days of delivery of your goods giving full details of any problems so that we take suitable actions to rectify mistake or replace damage or short goods as the case may be. a-Damaged goods. If you receive goods in a damaged condition, please make a note of this on the delivery dispatch note when signing, you will need to notify us of this by phone, email or letter in any case within 7 days from receipt of goods failing which we do not accept any liability. b-Quantity of goods It is your responsibility to ensure that you have signed for the correct number of goods delivered. At time of delivery you must also check that you have received the correct goods in accordance with your order. If you find that you have received incorrect goods or the wrong quantity of goods, you must make a note of this on the delivery /dispatch note when signing, you must then notify us of this by phone, email or letter in any case within 7 days from receipt of goods. Do not fit an item if it is damaged or an incorrect item. This counts as acceptance of goods and the item is then non returnable however small adjustments like damaged trim or move able parts can be rectified and supplied by us provided you report us within cooling off period. 9-RIGHT TO CANCEL You have the right to cancel your order at any time before or after goods are delivered to you for any reason but after they are delivered you have seven days cooling off period to return goods as explained below. In compliance with the distance selling regulations you have a Cooling Off period where you may withdraw from this agreement at any time up to 7 working days after the day we have delivered the goods to you. If we have delivered the goods, We want them back in pristine condition and resalable condition. You must return them to us at your own cost. A 20% restocking fee will be incurred when any goods are sent back unwanted after the 7 day cooling off period, this will be deducted from the your refund. When we receive the goods we will inspect them to ensure all manuals, accessories and other components are within the returned original packaging and that the goods are in the condition that we sent them to you. All items are subject to inspection. As a consumer you have a duty to return the goods in perfect condition. We advise that you should return the product in its original packaging as it will insure that the product is not damaged during transit back to us. Please send fully insured delivery back to us with prior arrangements with us. If goods arrive to us without our return number, damaged condition then we have a right to refuse so we will return them back to you and no refund will be given. 10-SPECIAL ORDERS We are unable to take back or accept items that are bespoke/made to order and unfortunately it is not covered in the distance selling regulations or Cooling Off period. Goods that are made to your specifications or personal requirements for example a burner to your specification is of no use to any one else so you are bound to keep it and dispose at your end if not required. 11-FAULT AFTER INSTALLATION If after fitting the product is found to be faulty, meaning your product shows symptoms of failure preventing basic operation (this does not include any superficial or cosmetic damages, for example scratches or dents). Please contact us at your earliest convenience. We shall then arrange through manufacturer an approved engineer to visit you free of charge and offer you the following options:- If repairable, the engineer will be able to carry out repairs on site or order parts and come back at your convenience to carry out the repair. It should not be considered degrading your product because engineer will fit brand new parts from manufacturer and your product remains as efficient or as new as just opened from a sealed box and installed. a-Replacement - we shall arrange for a replacement to be delivered to you at our expense and for the faulty item to be collected (usually at the same time). A full refund - providing the item has been verified by the engineer as being faulty and beyond local repair, we shall arrange for the item to be collected from your property and new item or a full refund given . If your item becomes faulty after having been fitted for more than 28 days, please contact the Manufacturer directly to arrange a service call, this is part of the manufacturer's guarantee however should you live in an area where there is no service coverage by their engineers, you must contact us for assistance. Areas normally effected are listed below :- Ireland Isle of Man Isle of Wight Jersey Guernsey Scottish Isles Scottish Highlands 12-COMPLAINT PROCEDURE If, in the unlikely event, you wish to make a complaint, please contact us in writing and our full details are given on contact us page. We shall then fully investigate the matter and contact you within 5 working days from receipt of letter. This guarantee is in addition to any warranties or conditions implied by law and nothing in these terms affects your statutory rights. 13-DELAY OR FAILURE TO PERFORM We shall not be liable to you if we are prevented or delayed in performing of our any obligations to you if this is due to any cause beyond our reasonable control e.g. An act of God, explosion, flood, fire or accident war or civil disturbance strike, industrial action or stoppages of work any form of government intervention a third party act or omission failure by you to give us a correct email or delivery address or notify us of any change of address If this happens we shall inform you as soon as is reasonably practicable and if these circumstances continue for 30 days either you or we will be free to cancel the contract.
